Hi everyone, here is a little disclaimer from me, Addy. These terms do seem very direct and maybe even a little harsh. This is for legal purposes and to protect me and this business as I do use it as a way to support my family. Even though the tone may seem very serious and direct, I want more than anything then for you to be happy with your piece, so please don't let these terms stop you from reaching out to me!

Online Store Conditions

This website is operated by Little Bean Birth Education LLC. Throughout the site, the terms "me", "I", "my", "we", "us", and "our" refer to Little Bean Birth Education LLC. By accessing and using my website, you accept and agree to be bound by these terms and conditions. PLEASE read them carefully before accessing or using the website, or before placing an order. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services it provides. You represent that you are over the age of 18. I do not permit those under 18 to use the services this website provides.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

Any new updates added to the current store shall also be subject to the Terms and Services. You can always review the most current version of the Terms and Services at any time on this page. We reserve the right to update, change, and replace any part of these Terms and Services at any time. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any updates constitutes acceptance of the new updates.

Our store is hosted on Shopify Inc. They provide us with the e-commerce platform that allows us to sell our products and services to you.

General Conditions

We reserve the right to refuse Service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Please be aware the pictures of you order may be used on social media platforms, set to customers as examples, and used on my website. No names or any other personal information will be shared. Only product images taken by me.

Custom & Personalized Orders

Due to the personalized and completely custom nature of our products all sales are final. We do not accept refunds. There are absolutely no returns or exchanges. You may cancel an order up to 3 days after placing an order. However I may have already started on your piece to keep turn around time accurate, so a restocking fee of 20 percent of the price or the item/item will apply.

If you would like to update your order please do so within 24 hours of ordering or I will no longer be able to make any changes. As I order supplies within 24 hours to make your customized piece and often will not be able to cancel or update those orders on my end. This is why I recommend triple checking your order details and being 100% sure of your ring size before ordering.

If your ring arrives in the size you ordered, but does not fit, I will not supply a replacement. You will have to purchase a new ring in the correct size.

If an item is defective upon arrival, incorrect, or lost in the mail, I will replace or repair your keepsake. Please reach out to me with any issues to see if your item qualifies for these services. Please double-check and triple check all personalization details (stone inclusions, ring size, birthstone requests etc.) before placing your order. If your piece arrives as ordered, even if you made a mistake when ordering, you will have to order a new piece if you want to correct the mistakes.

Products

All products are subject to availability. We reserve the right to discontinue any product at any time. Please keep in mind, I have done my best to represent my products accurately in product pictures.

I have done my best to accurately represent my products in the images in this website, but please keep in mind, due to the custom nature of every piece, results may vary and may not look completely identical to the picture of the product you ordered. I cannot guarantee that your mobile device or computer monitor's display of color will be accurate to in person products. Things like color of the milk stone, placement of inclusions, placement of hair, and so on with any inclusion you select, will vary from piece to piece. However, I do my best to keep products as consistent as possible.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors will be corrected.

We have the right to photograph or take videos of any items that we make and use them in any way we choose such as promotional materials for our website, social media, marketing, etc.

Stone design elements (crushed stone, flakes, etc.) added may make the stone surface rough, have micro bubbles, and not perfectly smooth. We cannot guarantee any keepsake stone to look "flawless".

Due to the uniqueness of your inclusions and the variable macronutrient/chemical makeup of breastmilk, stone density may vary for each piece. Some stones will be slightly harder than others because of this. As stated earlier, you must treat your precious stone as something you'd like to last forever.

Product Safety

WARNING: CHOKING HAZARD. Our items are made for adults only. Keep out of reach of children and animals. We are not liable for any damages done if these items are not kept out of reach of children or broken by children/animals. That is absolutely the parent/guardian's responsibility.

Product Materials

All metals and supplies are stated in the product listing as our trusted supplier has stated to us. I completely trust the suppliers I work with and they do a fantastic job. Metal will be stamped to ensure authenticity.

If you or the person who will ultimately receive the item has a known metal or resin allergy, you should consult your doctor before making a purchase. Our products are made with .925 sterling silver, 18K gold plating, rhodium plating, jewelers grade resin, and 14k solid gold. Little Bean Birth Education LLC is not liable for any physical reaction to our jewelry and will not refund items due to an allergic reaction.

Jewelry Care

Treat your keepsake for what it is! A way to preserve your precious memories forever. Treat it like you want it to last forever. This is not disposable jewelry and should be treated with much more care than typical jewelry do to its special purpose.

Do not shower, bathe, work out, sunbathe, swim, or sleep while wearing your jewelry. Do not expose your jewelry to chemicals (lotion, perfume, hairspray, laundry/dish soap, etc.), extreme temperatures, humidity, extended UV light, or essential oils. Do not store your jewelry in direct sunlight or in a humid area like a bathroom. This will prevent discoloration of the resin stone. Not following these instructions may result in a discoloration of your resin stone. We recommend storing in a dark, dry area - preferably a closed anti tarnish jewelry box. Do not store mixed metals together as that can accelerate tarnishing. For example, do not store silver pieces in the same place as gold plated pieces.

Clean with gentle soap and water and dry promptly and gently to avoid scratching. On 925 sterling silver metal you may clean with a silver polishing cloth if you notice discoloration, but avoid rubbing it on the resin stone.

Little Bean Birth Education is not responsible for any damage done to your keepsake by not following these instructions and will not provide a replacement.

Tarnishing and Plating Stripping

We take pride in the fact that our pieces are made to last. We use .925 sterling silver, 18k gold filled,14k solid gold, and 18k gold plating/rhodium plating on various pieces. The plating on plated pieces will wear off and need re-plating at some point since they are not that color all they way through. You are paying for the sterling silver underneath the plating and the craftsmanship. I offer plated pieces in order to make the effect of gold jewelry accessible to all mamas and all budgets as solid gold is quite expensive. Plating lifetime depends on many factors such as an individual's body chemistry, time spent wearing the piece, jewelry care, etc. If plating wear concerns you, we recommend purchasing a silver or 14k solid gold piece that will not require re-plating. Local jewelry stores offer plating services for a small fee. We recommend having the jeweler remove the keepsake stone before plating and re-setting the stone after plating. Bezel setting cannot be plated again as the stone cannot be removed. A polishing cloth and box or bag is included with every jewelry order. You can use this cloth to polish silver and solid gold pieces. We caution against using the cloth frequently on plated pieces and gold filled pieces as it can strip the plating.

4. Pricing

All prices are listed in USD and are subject to change without notice. They are based on supply costs and shipping rates and may fluctuate. All orders are final and paid in advance. We reserve the right at any time to modify prices or products at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

5. Shipping Keepsakes

You are responsible for shipping and funding the shipping for your keepsakes. Little Bean Keepsakes is not responsible for any keepsakes lost or damaged in the mail. NEVER send me all of your keepsake items. Always keep a little bit incase things are lost in the mail and you need to send more. By placing an order, you accept the fact that the shipping of your keepsakes, and what happens to them during shipping is completely out of my control. They can get lost or damaged. It does happen. If keepsake items are lost or damaged in the mail, you will be responsible for shipping and funding the shipping of the new keepsake. Again, DO NOT send me the last of your milk or keepsake.

Instructions on how to ship your keepsakes can be found on my website. There is a button on my home page titled "Shipping You Keepsakes" that will tell you everything that you need to know.

If you ship your keepsakes to me using these instructions before you have officially placed and paid for your order, they will be discarded and you will be required to send more once your order is officially placed.

I will keep any extra preserved milk on file if you would ever like to place another order. I do not keep any other keepsakes on file, but will send them back upon request for you to hold onto. Cremation ashes will always be treated with great care and respect and every bit that goes unused will be sent back to you. No need to request it.

Little Bean Birth Education LLC is not liable for breastmilk/any other keepsake inclusions that are lost or damaged due to accidents/events including but not limited to: robbery/theft, fire, flood, tornado, hurricane, earthquake, blizzard, or any other "Act of God". For this reason, please do not send the last of any irreplaceable material. You acknowledge and agree that sending breastmilk or keepsakes is done at your own risk and that you will retain a backup amount.

Turn Around Time

Turn around time is anywhere form 5-10 weeks depending on what you order and what customization you select. Turn around time begins the day I have received both milk and payment. I will do my best to complete orders within this time but it is always subject to change and not a guarantee due to but not limited to unpredictable factors like shipping delays, emergency situations, manufacturing errors that need to be corrected, damaged keepsakes, etc. By placing an order you understand that your piece may not arrive within the expected turn around time. You are responsible for ordering in enough advance if you need a piece by a specific time. I can never guarantee a specific arrive time, but you may always message me questions about the status of your order. A keepsake arriving late is not a reason for any sort of refund, as you will still receive you order completed to order.

Intellectual Property

All content on this website, including images and text, is the property of Little Bean Keepsakes and may not be reproduced in any way without written permission given by me. You may post pictures of your piece online, but by doing so you agree to tag my page in any posts. Do not try and pass any product as your own.

Accuracy, Completeness, and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Personal/child/animal Safety

I work in a well ventilated room and never expose children or animals to the products I use. I wear proper safely equipment when necessary to protect myself as well.

Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

User Comments, Feedback and other Submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Errors, Inaccuracies, and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Prohibited Uses

In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. Warranty Information

If your item or items arrive damaged I will replace it. If your item or items are lost in the mail, I will replace it. If any warping of the piece or milk stone, gem or milk stone loss, or discoloration of milk stone happens within the first three months of receiving your item, it is most likely do to manufacturing error. If discoloration or warping is a result of a preservation/crafting error, it will occur in the first 3 months (90 days). We guarantee no discoloration will occur in the first 3 months (90 days) after you receive your item. We cannot guarantee past that as we have no way of knowing whether the jewelry piece was mistreated (i.e. client has not followed our jewelry care instructions). Discoloration can eventually occur on ALL resin items due to the chemical properties of all resin products. As stated in the jewelry care instructions, please keep our pieces out of extended sunlight, away from heat, chemicals, water, etc. We use jeweler's grade resin which contains UV stabilizers that guard against discoloration, however no resin is 100% able to mitigate damage from harsh chemicals, heat and extended UV light.

Plating wearing off does not apply to this warranty as it is completely dependent on wear time, skin type, and how the piece is treated.

Past three months I cannot grantee any of these replacements as I have no way of knowing if jewelry care instructions were followed.

However, I do know how important these keepsakes are to my customers. If a milk stone falls out at any point, and you still have the intact ring setting, you may send it in to me to be replaced if I have your milk on file. You will be responsible for paying for the shipping of the setting to me, and the shipping getting it back to you.

Disclaimers of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Little Bean Birth Education LLC., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless Little Bean Birth Education LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
